If you have never had a prior felony conviction and are arrested with up to 1 pound, then your sentence must be probation with drug treatment, although the duration is determined by the judge. In this situation, the judge may also waive the fines if he or she deems fit.

From here, however, there is no leniency and no exceptions. For possession of 1-5 pounds, the minimum sentence is 6 months and there is no probation option. At this weight, the crime is considered a “state jail felony,” meaning it is treated as a felony charge but results in time in a minimum security prison with non-violent offenders.
The penalties quickly increase after the 5 pound limit since the court considers you a large trafficker. These crimes are felonies and treated as such:
- 5-50 lbs results in 2-10 years and up to a $10,000 fine
- 50 lbs – 1 ton results in 2-20 years and up to a $10,000 fine
- 1 ton or more results in 5-99 years and up to a $50,00 fine
